General terms and conditions for the booking of information events, seminars and trainings (public and in-house).
1. Scope of the General Terms and Conditions
The following general terms and conditions regulate the contractual relationship between the participant of information events, seminars and trainings (in the following “event”) and Jensen & Komplizen GbR (in the following “Jensen & Komplizen”). Differing general terms and conditions of the participant are not valid.
2. Registration/Registration Confirmation
Your registration can be done via internet, email or telephone. The registration becomes legally binding with our written confirmation.
3. Scope of Service
The participation fee is calculated per person and event date plus the statutory VAT. It includes conference materials, catering and lunch at open seminars/trainings. Jensen & Komplizen reserves the right to replace announced speakers with others if required and to make necessary changes to the event programme while maintaining the overall character of the event.
If the event cannot be held due to force majeure, because the speaker is unable to attend, because of disturbances at the event location or because the number of participants is too low, the participants will be informed as soon as possible in advance to the event.
Cancellation due to an insufficient number of participants will be made no later than 1 week before the event. If the event is cancelled due to an insufficient number of participants (less than 4 participants), the seminar fee can either be refunded by Jensen & Komplizen or an alternative date can be booked.
A claim for reimbursement of travel and accommodation costs or for lost working time is excluded, unless such costs arise due to grossly negligent or intentional behaviour on the part of Jensen & Komplizen.
In case of possible impairments of performance Jensen & Komplizen commits itself to take all reasonable steps to eliminate or minimise the disruption. In these cases Jensen & Komplizen offers live online seminars/trainings for the participants. These take place live and interactively. This ensures seminar participation independent of location.
4. Due Date and Payment, Delay of Payment, Offsetting
The participation fee is due within 14 days upon receipt of the invoice. If the participant does not pay on time, Jensen & Komplizen is entitled to charge default interest of 9% above the base interest rate (section 247 paragraph 1 German Civil Code) p.a. If Jensen & Komplizen proves a higher damage caused by the delay, this damage can be claimed.
Likewise, the participant is entitled to prove that no damage has occurred at all or that the damage is considerably lower than claimed by Jensen & Komplizen.
Payment is to be made by invoice. Payment by sending cash or cheques is not possible; Jensen & Komplizen does not assume any liability for loss.
The participant can only set off claims that are legally determined or accepted in written form by Jensen & Komplizen. The participant is only authorized to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.
A cancellation (only in written form) is possible free of charge up to 30 calendar days before the start of the event. In case of a cancellation within less than 30 days and up to 15 days before the start of the event, 50% of the seminar price will be charged. After that, 80% of the participation fee is due until the 4th day prior to the start of the event. From the 3rd day before the start of the event the full participation fee is due. The participant is entitled to prove that the cancellation of the event did not cause any damage at all or that the damage is considerably lower than the cancellation fee charged by Jensen & Komplizen.
The conference, seminar and training documents are protected by copyright. Copying, forwarding or other use of the conference documents is only permitted with the express written consent of Jensen & Komplizen.
The events are carefully prepared and carried out by qualified speakers. Jensen & Komplizen assumes no liability for the topicality, correctness and completeness of the conference documents and the execution of the event.
8. Applicable Law, Place of Jurisdiction and Place of Performance
The contract is subject to German law. To the extent permitted by law, Hamburg is agreed as the place of performance and jurisdiction.
9. Right of Cancellation for the Customer
You have the right to cancel the registration in written form within 14 days after receipt of the registration confirmation without stating reasons. Cancellation fees will not be charged. The timely sending of the revocation to the following address is sufficient to meet the deadline:
Jensen & Komplizen, Bahrenfelder Straße 52-54, 22765 Hamburg, Germany
In order to comply with the revocation period, it is sufficient if you send the notification of exercising the right of revocation before the end of the revocation period.
This right of cancellation does not apply if the event booked took place and the participant attended it.
Consequences of revocation: If you revoke this contract, we must reimburse you for all payments we have received from you immediately and at the latest within fourteen days after we have received the notification of your revocation of this contract. For this refund we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this refund.
10. Data Protection
Jensen & Komplizen protects your personal data.
Jensen & Komplizen will treat the data provided by the buyer strictly confidential. We use the data collected in the context of your order and use of our offer within the applicable legal limits for the purpose of providing our services and to send you information by post and email about further offers from us and our partner companies which are similar to the services previously received by you.
